Recent Court Ruling Upholds Equitable Subrogation
Lenders now have more reason then ever to be vigilant in ensuring that there are no other mortgages on real estate which they are refinancing.  On
November 28, 2006, a special panel of the Michigan Court of Appeals ruled that a lender who refinances a real estate loan and secures the refinancing with a mortgage is not entitled to have the same priority for its mortgage as the original lender’s mortgage.  See More

Recent Court of Appeals Ruling May Significantly Reduce State Transfer Taxes
The Michigan Court of Appeals ruling in Lake Forest Partner 2, Inc. v Department of Treausry that the transfer tax calculation shall be based upon the value of the property at the time the purchase agreement is entered into and not at the time of the acutal transfer may sigfinicanly reduce the transfer tax liability where the purchase involves new construction. See More

November 17, 2003, Evans & Luptak won an important victory by successfully defending against a class action filed by mortgagors in the Berrien County Circuit Court which alleged that the financial institutions' imposition of a discharge of mortgage fee was unlawful. See More

Evans in 1930 as a sole practitioner, making Evans & Luptak one of the oldest firms in the metropolitan Detroit area.  The law firm initially concentrated in the specialty of tax law and has used this base to develop in all areas of business law, including mergers, acquisitions, real estate, partnerships, corporations, banking, securities, estate planning, employee benefits, business litigation and bankruptcy.

 

          The firm’s typical client is a small to medium size manufacturer, real estate developer, retailer, bank or service organization.  Purposefully, growth has been restricted to maintain the intimacy of a small law firm that brings clients quality service on a personal basis.  Because of our medium size, attorneys in different areas interrelate easily and support each other.
